Terms of Service

1. Acceptance of Terms

By booking a boat tour with Your Summer Croatia, you agree to be bound by these Terms of Service. These terms apply to all bookings made through our website, phone, email, or in person. If you do not agree with any part of these terms, please do not proceed with your booking.

2. Booking and Confirmation

All boat tour bookings require a completed reservation with valid payment details. A confirmation email will be sent within 24 hours of a successful booking. You are responsible for providing accurate personal information and contact details. Please review your booking confirmation carefully and contact us immediately if there are any errors.

3. Cancellation and Refund Policy

Bookings may be cancelled with a full refund up to 24 hours before the scheduled tour departure time. Cancellations made less than 24 hours before departure are non-refundable. Weather-related cancellations initiated by Your Summer Croatia entitle guests to either a full refund or a free rescheduled tour at a mutually agreed date. In cases of unsafe sea conditions, we reserve the right to postpone or cancel tours without penalty to the guest.

4. Weather-Related Changes

Your safety is our top priority. If dangerous weather conditions develop before or during your tour, we may alter the itinerary, shorten the tour, return to port, or postpone the tour entirely. In such cases, you will receive either a full refund or the option to reschedule your tour for another date at no additional cost. Decisions regarding weather safety are made at the sole discretion of the boat captain and Your Summer Croatia management.

5. Age and Ability Requirements

Guests must be at least 5 years old to participate in boat tours. Children under 18 must be accompanied by an adult (18+ years) at all times. All guests must be in reasonable health and physically capable of boarding and exiting the boat safely. If you have mobility concerns or health conditions that may affect your participation, please notify us before your tour. Guests who appear intoxicated or are unable to follow safety instructions will not be permitted to board.

6. Safety Requirements and Conduct

All guests must follow the instructions of the boat captain and crew at all times. Life jackets and safety equipment must be worn as instructed. Swimming is only permitted at designated stops. Guests swim at their own risk and agree to assume all risks associated with swimming in open water. Guests must not bring glass bottles, operate the boat controls, or engage in behaviour that endangers themselves or others. We reserve the right to refuse service to anyone who violates safety rules or displays disruptive behaviour.

7. Payment Terms

Payment must be received before the tour departure. We accept credit cards, bank transfers, and cash (at the harbour). Prices are quoted in EUR and are subject to change without notice, though prices quoted at time of booking are guaranteed. No refunds are issued for unused services or partial participation in tours.

8. Limitation of Liability

Your Summer Croatia operates boat tours in accordance with Croatian maritime law and international safety standards. However, you acknowledge that boat tours involve inherent risks including but not limited to rough seas, weather changes, sun exposure, and physical exertion. By booking and participating in a tour, you voluntarily assume all risks associated with water activities. Your Summer Croatia, its owners, employees, and contractors shall not be liable for any injury, loss, damage, or death that occurs during or after the tour, except as required by law. In no case shall our liability exceed the amount paid for your tour.

9. Personal Property

Your Summer Croatia is not responsible for loss, theft, or damage to personal belongings left on the boat or in unsecured areas. We recommend not bringing valuables on tour. While we take reasonable precautions to protect your belongings, participation in the tour is at your own risk.

10. Medical Conditions and Medications

If you have any medical conditions, allergies, or take medications that may be affected by sun exposure, physical activity, or motion at sea, please inform us before your tour. We are not medical professionals and cannot provide medical advice. It is your responsibility to ensure you are fit to participate and to bring any necessary medications.

11. Photography and Media

You grant Your Summer Croatia the right to photograph or film you during your tour and to use these images for marketing and promotional purposes unless you explicitly request otherwise in writing. Professional photography equipment may not be used without prior permission.

12. Intellectual Property

All content on the Your Summer Croatia website, including text, images, logos, and design elements, is the exclusive property of Your Summer Croatia or licensed to us. You may not reproduce, distribute, or use any content without prior written permission.

13. Changes to Tours and Itineraries

While we make every effort to deliver tours as advertised, Your Summer Croatia reserves the right to modify routes, stops, or timing based on weather, sea conditions, guest requests, or operational needs. We will make reasonable efforts to notify guests of significant changes in advance.

14. Governing Law

These Terms of Service are governed by the laws of Croatia. Any disputes shall be resolved in the courts of Croatia or through alternative dispute resolution methods.
